How it works

Every estate is a little different, and the legal steps are handled by your attorney and the court. Here's the general shape of how a probate home sale works in Michigan, so you know what to expect.

The estate is opened and a representative is appointed

The probate court issues Letters of Authority — the document that gives the Personal Representative (often called the executor) the legal authority to act for the estate, including selling real estate.

We walk the property together

We look at the home, talk about its condition and what's inside, and figure out your goals — sell it as-is, clear it out first, or somewhere in between. No repairs or cleanup needed before we talk.

We price it and prepare

I'll give you a clear market valuation based on recent local sales, and we decide together how much — if anything — to do before listing. Estate homes very often sell as-is, and I can bring in trusted cleanout and estate-sale help if you want it.

We list and market the home

Full marketing — professional photos, the MLS, and real exposure to buyers across Southeast Michigan — presented honestly as an estate sale.

We handle offers and any court requirements

I'll help you weigh offers and coordinate with your attorney on anything the estate or court needs along the way. Some estates involve extra steps, like a creditor notice period — your attorney will confirm what applies to yours.

Can we sell the home before probate is finished?

Often, yes. Once the Personal Representative is appointed and has Letters of Authority, they can usually list and sell the property while the estate is still open. Your attorney can confirm what your specific estate allows.

The house needs work and is full of belongings. Is that a problem?

We live out of state. Can you still help?

Yes — this is common. I regularly help out-of-town families and executors handle the entire sale remotely, keeping you updated every step of the way, from the first walkthrough to the closing table.

What if the heirs don't agree on what to do?

It happens more than you'd think. I keep everyone informed with the same clear picture so decisions are easier, and I always defer to the Personal Representative and your attorney on final decisions.

How long does a probate sale take?

It varies. Once you're appointed, a straightforward sale can move at a normal pace; estates with complications take longer. I'll give you a realistic timeline for your specific situation early on, so there are no surprises.

Will we owe taxes on the sale?

That depends on the estate, and it's a question for your attorney or tax professional. In many cases, inherited property receives a "stepped-up" cost basis that can reduce capital gains — but you'll want a professional to confirm what applies to you.
